UIGEA has still not gone into effect. And even though
this will change come December 1, 2009, financial
analysts predict that business will go on as usual.

gambling online...

Gambling Ban to go in "Effect" December 1, 2009
Considering the Unlawful
Internet Gambling Enforcement Act was passed back in
2005, it seems somewhat surprising that it still has not
gone into effect. But then again, if you consider all of
the flaws in the legislation, not to mention the burdens
it places on the financial industry, you might say the
UIGEA has never really been an "effective" piece of
legislation to begin with. Nonetheless, the UIGEA is
actually supposed to go into law in just one month.
December 1, 2009 is basically the deadline that banks
have to begin enforcing the law. In other words, come
December 1st, banks are required to cease processing
transactions used for online gambling. Well, I take that
back. Not just online gambling, but certain forms
of online gambling. A carve-out ridden piece of
legislation (the UIGEA allows for horse racing bets and
fantasy sports), this is precisely why online casino
gamblers and poker players need not worry about being
denied their online gambling fix. The American Banking
Association (whose members represent something like 95%
of banks in the U.S.), have long been saying it will be
nigh impossible to police and identify all of the
transactions used for online gambling purposes, and that
placing this burden on the private financial sector is
unfair and unrealistic. And never mind the fact that
online casinos have found inventive ways to securely
process transactions, while simultaneously bypassing any
red tape. Certainly, the UIGEA has been a major nuisance
to many a top-tier online gambling business - but,
that's how it goes...for now. The reality is that
it probably won't be long before the UIGEA gets
overturned with legislation to tax and regulate online
gambling - even if it's just for online poker. Reports
now show that regulating online poker in the U.S. would
generate nearly $42 billion in taxes over the next
decade - and you can rest assured these numbers have
caught the attention of the U.S. Congress, sixty members
of which have already signed on to support the Safe and
Secure Internet Gambling Initiative, which reports that
Americans gamble nearly $100 billion a year on the
internet. |
