Handing out RNG Certifications Quick and Easy, but so what?

First off, let me just say that I’m in somewhat of a bad mood. Therefore, if I come across as a little caustic and biting in regards to what I’m about to pontificate on, you’ll know it’s not entirely without merit. Heck, I’m probably not giving myself enough credit, considering I’m generally a very nice guy. Living here in Brooklyn, NY, some people would even say “too nice”. In other words, I think many of you may very well agree that I have a goddamn right to be pissed off.

Let’s begin then, shall we? So, about a month ago, the team here at Online Casino Suite (small but powerful, let me tell ya) decided to start an in-depth blog series uncovering the finer points of online gambling regulation. In particular, we thought it would be most helpful to explore the range of independent fairness certifications being awarded to online casinos regulated in “iffy” jurisdictions or those not receiving any regulation whatsoever, i.e., Costa Rica. I’ve said this a million times over, but I guess one can’t say it enough – Costa Rica does not regulate online casinos. They simply hand out business licenses. Woo Hoo! Go Costa Rica! Right?

Anyhow, we decided to contact these online casino software “fairness certifiers” one by one, asking them if they would be so kind to explain just how far these certifications can guarantee a safe hand, and depending on the type of certification and the regulatory jurisdiction, whether or not some online casinos are potentially offering less fair odds than others.

The big software fairness certifiers – as you may already know – are Technical Systems Testing, Certified Fair Gaming, Gambling Associates, Price Waterhouse Coopers, BMM International and eCOGRA. And of course, many of the top government-run regulatory jurisdictions, such as the UK, Gibraltar and Malta, do certifying of their own.

Of all of these aforementioned companies, we decided to start with Technical Systems Testing, otherwise known as TST – the main reason being that we have come across more irregularities with online casinos boasting a certification with TST. For example, the most popular group of online casinos operating on the Top Game Software platform, Rome Partners, sports a TST fairness logo on the homepage of their sites. However, not only does this logo link to a press release from nearly a year ago (not an actual certification), the press release describes an accreditation of the Top Game software platform, not of each individual online casino.

Why does this matter? Well, for one, it is unclear which regulatory jurisdictions allow online casino operators to change the source code of their RNG. This is essentially what delivers a fair hand or more or less fair hand. So, for an online casino “licensed” in Costa Rica, where ongoing audits are not enforced, a TST certification of the software platform means absolutely nothing. The online casino operator could very well go in and change the source code at any time.

I dare anyone to challenge me on this and explain how this is NOT possible. Believe me, I’m not saying I know without a doubt. But where’s the information pointing to the contrary. Nobody is taking the time to explain anything. And to be honest, it should be freakin’ TST!!!! They’re supposedly handing out the certification, are they not? But guess what? All TST wants is for Online Casino Suite to do a positive write-up about them.

So ya, after contacting them with these questions, they replied and said these were “very good” questions, albeit the answers to said “very good questions” would be lengthy and require some time to prepare. They then proceeded to suggest a phone conversation as an alternative, but have since stopped replying to our emails to set up such a phone conversation.

So, where are you TST? Can you please explain the validity of your certifications? Can you please explain why online casinos like Rushmore Casino, Silver Oak, Aladdin’s Gold are not given a certificate to link to, but just simply say they are TST Certified. I’m not saying they are not – All of the aforementioned online casinos are great in my book. But where’s the transparency? It’s freakin’ ridiculous that a company as global as TST (tstglobal.com) does not have a policy in effect governing how casinos may or may not display a TST certified logo.

British Columbia Lottery Corp. Online Casino, PlayNow, Crashes in Hours of Launch

There is no questioning just how much Canadians love to gamble online. And not that they are any different from the rest of us, it’s simply that Canadians now have a government regulated internet betting site to wager real money with. The first ever North American, government regulated online casino – PlayNow.com – was recently launched by the British Columbia Lottery Corporation.

However, just as quickly as it was launched, the site was shut down. No, it wasn’t taken out by Canadian authorities or by hackers even.  Within hours of going live, the PlayNow online casino shut down due to an overload of traffic.

In other words, the website was swamped with visitors within hours of launching on the Web, and consequently crashed. Making a quick decision to shut the site down completely, the BC Lottery Corporation immediately began adding more data servers and strengthening the infrastructure of the website. To this hour, work is still being done to ready the site for a re-launch. A far cry from the flashy bonus offers and animated casino games, all that remains now on the PlayNow homepage is a message stating that PlayNow is currently unavailable.

Quick to criticize the decision to allow an online casino to be launched under the control of the BC Lottery, the anti-gambling camp used the news of the website overload to back their claims that with legalized internet betting too many Canadians will gamble at online casinos, become addicted and usher a domino effect of negative consequences.

Truth be told, the exact number of hits incurred by PlayNow.com has not been revealed, which basically means that other factors could have been in play besides an overload of traffic. It isn’t clear just how many of the site visitors were actually participating in online gambling activities or were simply giving the website a look-over for possibly giving it a go at a later time.

Well, that “later time” could be any second or any day, depending on how quick the backend tech guys get the website revamped. No word has been given by the BC Lottery Corporation just yet. However, all you Canadian gamblers can rest assured that PlayNow will be going online again. If your government didn’t know just how badly you needed and/or wanted a “home” online casino, they certainly do now.

When MTV starts showing an interest in online bingo, let’s just say the notion that only old people play bingo stands no more. In fact, it’s evidence that such a notion has been smashed to pieces. For those of us keen to the online gambling scene, the rise of bingo has been quite apparent over the last five years or so. While at first primarily attracting women in the 40’s range, online bingo is now popular with both sexes in their twenties and thirties.

So yes, MTV is indeed showing an interest in online bingo – so much so, let’s just say there is no backing out at this point. Inking a deal with 888 Holdings’ Dragonfish bingo solutions network, MTV Networks UK and Ireland divisions will be launching a new online bingo site this month, initially as a skin of the Dragonfish Network.

What that means is that MTV will be advertising it’s new online bingo site with the hopes of drawing in a younger, hipper demographic to have a go at winning some money and engaging in like-minded chat. It also means that online bingo may never again be the same.

Giving a visit to the new skin site – fittingly named UpYourBingo – I was impressed with the layout. However, the touch of MTV is sorely missing, and one would hope they give the site a huge makeover courtesy of the X and Y generations. If this means incorporating music videos while you play, music streaming or irreverent comedic anecdotes throughout the site and chat rooms, then so be it. I just hope this isn’t a profiteering venture of the part of MTV, resulting in just another bingo room without any personality. What is this like sixty bingo rooms now in the Dragonfish network?

That’s one reason why I personally like the World Bingo Network’s Desperate Housewives Bingo Room. Admittedly, my first interest in this room was to get hooked up with a desperate housewife in one of the chat rooms. But ever since a long conservation with my priest and being won over by everything else this online bingo room has to offer, I can say that Desperate Housewives is a solid bingo room with so much more than….you know what I mean.

Needless to say, both Dragonfish and MTV are getting all gooshy over one another. In a recent press release, both companies said the same-ol’, same-ol’ “we are really excited to be partnering with one another” and such forth. Indeed, the partnership holds great potential for the UK and Ireland facing online bingo community.

European Court of Justice Ruling Viewed as a Setback for Online Gambling Liberalization

“Discriminatory” is a tricky word. In fact, it’s trickier than the the word tricky itself. You see, an entire European Court of Justice (ECJ) ruling rests on this lone, yet powerful word. And I’m not talking about just any ruling. As you might guess, this being the Online Casino Suite Blog and all, said ECJ ruling pertains to online gambling activities.

Said ECJ ruling is also a big blow to liberalizing online gambling laws in Europe, and consequently, centralizing regulatory protocols. Although the ruling is specifically applicable to advertising, the larger principle of the matter conjurs up the notions of protectionism – something many EU member States know all too well.

This time around, Sweden is at the heart of the ECJ case which ruled that a national ban in Sweden against advertising offshore internet betting services could be imposed on religious, cultural and/or moral grounds, so long as such as ban was not “discriminatory” (there’s that magic word) in practice. The ruling further stated that Swedish legislation prohibiting the promotion of online gambling services by operators in other EU member states for profit is “consistent with Community Law.”

On a side note, the one component of the ECJ ruling that could be seen as a small dent to protectionist activities in Sweden states that laws imposing administration penalties on Swedish-based gaming companies operating without proper licensing credentials need to reflect current laws imposing criminal sanctions against offshore operators advertising in Sweden. In other words, everyone needs to play by the same rules.

The ECJ is certainly no stranger to cases pertaining to cross border gambling activities. Being a relatively young and lucrative industry, contention is practically a given. There is lots of money to be made on the internet, and even more at gambling. So, it’s pretty understandable when outside operators swoop in to profit, yet return nothing back to that particular economy.

With regulation, this is not so much an issue. However, now that more European countries are regulating online gambling, they are doing all they can to profit the most off their specific constituents. In other words, state-run operations are the way to go if a government is seeking more than just licensing fees from outside online operators.

Look out Atlantic City, table games have been let loose in Pennsylvania casinos. Just days after the Rivers Casino in Pittsburgh, Meadows Racetrack & Casino and Presque Isle Racetrack & Casino in Eric, PA, opened table games to the general public under new legislation passed in January of this year, three more casinos have followed suit. Now included in the ranks of Vegas-esque casinos are the Mohegan Sun, Mount Airy Casinos and the Hollywood Casino outside of Harrisburg.

Considering that the first slots casinos in PA opened in 2006, the development of the brick ‘n mortar gambling industry has certainly come a long way in a short time. Needless to say, getting table games legalized is no easy task, let alone slot machines. The Seminole Indians were at it for years in Florida before successfully getting table games included in their repertory of wagering options.

Couple this with the resistance imposed by nearby Atlantic City, New Jersey, where casino gambling has long been a hub for residents in Northeast America, and you have yourself a classic “made in America” love story. And not that Pennsylvanian’s are really that much in love with casino gambling to begin with, but rather, that anything is possible with enough money and government support. Okay, maybe that’s not a classic American love story, but it’s definitely an American tale.

The Mount Airy Casino Resort in the Poconos has come out with the most table games – 72 to be exact – while Mohegan Sun at Pocono Downs, has opened a floor with 62 table games. Hollywood Casino has unveiled 52 new table games, which include twenty-two blackjack tables, four craps tables, four roulette tables and a poker room with twelve tables poised for tournament action.

The new casino offering is expected to bring in tens of millions of dollars for PA State and County government via a 16% tax rate on the revenue earned at table games. Further helping the Pennsylvania economy are prospects of approximately 4,400 new jobs as a direct result of table games. These include pit bosses, dealers and cashiers.

Poker Stars Passes Increased Rake Fees onto Unhappy Players in France

Here’s a message for all you lawmakers out there contemplating drawing up laws to regulate online gambling. Write a law to actually regulate online betting activity, not hinder it. Sure, taxation and regulation tend to go hand-in-hand. But when the taxation policy does not make it worthwhile for operators to do business, then it kind of defeats the purpose does it not?

In the UK, where strict regulatory laws have driven out several top-shelf online betting operators in the last few years, in France, some operators are choosing to pass increases in taxation onto the players themselves. More specifically, the popular online poker room, Poker Stars has dumped a 2% increase in rake charges on French players, as a result of new regulatory laws – which for all intensive purposes – are supposed to liberalize online gambling in France.

Beginning earlier this month, the French government gave an open invitation to offshore betting operators seeking to do business with French citizens – and Poker Stars was one of them. The only catch was that the operators would be required to pay more in taxes than what they were generally accustomed to in other regulatory jurisdictions.

Instead of sucking up the loss, Poker Stars has decided to make the players pay. Mind you, these are the same players who helped make Poker Stars become one of the most popular online poker rooms in the world. Needless to say, players from France are up in arms about the decision to raise the rake charge up to 7.7% (the percentage amount of the pot that is deducted and paid to Poker Stars every hand), and have formed a coup d’etat of sorts.

Taking advantage of the rule called a “sit out”, French players have successfully managed to impose a boycott on Poker Stars. Permitting seated players to “sit out” a hand at a table, the rule is now being exploited to the point where some entire tables are being “sat out” by players. Taking note of the uprising, Poker Stars defended its decision, stating they have been losing money themselves as a result of raised taxes. However, you and me and all the players at Poker Stars know that’s absolute BS.

I guess then it comes down to how greedy does Poker Stars want to be? Whether the staged sit-outs will be enough to get the world’s most popular online poker room to rethink increased rake fees for French poker players remains to be seen.

Eastern European Governments Open to Prospect of Regulating Online Casinos

These days, the benefits of regulating online gambling are looking, well, more beneficial. Especially in countries that are experiencing more hardship during these tough economic times, any way to generate more tax revenue to keep government programs afloat is more readily embraced, even by those who would normally be in opposition.

Such is the case in Eastern Europe, where the governments of both Romania and Moldova are seriously considering the prospects of legalizing and regulating many forms of internet betting, including online casino gambling. In Romania alone, it is estimated that $500 million Euro’s are spent wagering online.

Secretary of State for the Finance Ministry of Romania, Bogdan Dragoi, has openly stated that the Finance Minister is seeking to investigate the prospects of regulating online gambling. Doing so would assuredly help Romania’s ailing economy, which was hard hit by the global recession. Currently the law prohibits gaming operators from doing business with operators, but does not prohibit Romanians from partaking in online gambling activities, which many assuredly do.

Giving promise to the potentially positive effects of regulating online casinos in Romania is last year’s amendment to a law regulating brick ‘n mortar casinos. By simply raising the tax rate on casinos, the government was able to substantially increasing gaming revenue. Although applying to the land-based industry, the principle of taxation coupled with a demand for gambling by many Romanian’s cannot be denied.

In nearby Moldova, the Ministry of the Economy has initiated a project with funding from the European Union to amend current gambling regulations. Becoming compliant with EU trade laws is helping to facilitate the project, which currently is making slow progress. If and when a majority consensus is obtained regarding how to go about setting up effective regulatory framework, it is rumored that both Party Gaming (Party Casino) and Poker Stars will be amongst the first to apply and likely be issued online gaming licenses for doing business in Moldova.
